Terms of service

The agreement between you and Avalore Ltd for using Cinch. Written to be read, not skimmed past.

These terms are between you and Avalore Ltd (“we”, “us”), the company behind Cinch. By creating an account or using the service you agree to them. If you are agreeing on behalf of a business, you confirm you are allowed to bind it.

1. The service

Cinch lets you build multi-step quiz funnels, publish them as a hosted link or an embed, collect responses, and send those responses to services you connect. We add and change features over time. If we remove something you rely on, we will give reasonable notice.

2. Beta

Cinch is in beta. Features may change, break or be withdrawn, and data loss, while something we work hard to prevent, is a real risk in a young product. Keep your own copy of anything you cannot afford to lose, and do not rely on the service for anything safety-critical.

3. Your account

  • You must be 16 or older and give accurate details.
  • Keep your login credentials secure — you are responsible for what happens under your account.
  • Tell us promptly at hello@cinchfunnel.com if you suspect unauthorised access.

4. Your content and your respondents

You keep all rights to the funnels you create and the responses you collect. You grant us only the licence we need to host, display and deliver them on your behalf, and to make backups.

You are responsible for what your funnels ask and what you do with the answers. That means:

  • Having a lawful basis to collect and use the personal data you ask for, and telling people what you will do with it.
  • Publishing your own privacy notice where the law requires one.
  • Getting proper consent before collecting anything sensitive — health, financial or similar — and not using Cinch to collect payment card numbers or passwords directly.
  • Honouring requests from your respondents to access or delete their data.

As between us, you are the data controller for responses and we are your processor. Our privacy policy explains how this works.

5. Acceptable use

You agree not to use Cinch to:

  • Break the law, infringe anyone's rights, or promote hate, harassment or violence.
  • Run scams, phishing, fake giveaways, or anything designed to mislead the person answering.
  • Distribute malware, or attempt to breach, overload or reverse engineer the service.
  • Resell Cinch as your own product, or scrape it at scale.
  • Send unsolicited bulk email to addresses collected through it, in breach of PECR, GDPR or equivalent rules.
  • Switch on advertising pixels without the consent your visitors are owed. If you add a Meta, TikTok, Google, LinkedIn or X pixel to a funnel, those trackers are yours: you are the controller, and PECR, GDPR or the equivalent where your visitors are is yours to satisfy, exactly as it would be on your own website.

We may suspend or remove funnels that breach this, and will tell you why where we can.

Fair use

“Unlimited” means we do not meter your funnels or your responses, and we do not intend to start. It is not a licence to resell capacity or to run someone else's platform on one subscription. Two things do cost us per unit, so they carry stated limits rather than vague ones:

  • Connected domains. Pro covers five custom domains per account. Ask if you need more — for a normal agency the answer is yes, and it is free.
  • Notification email. Sent on your behalf at a volume that suits one business. Sustained bulk sending is not what it is for.

If an account is costing materially more to run than it pays, we will email you and talk about it before we do anything. We will not throttle a funnel mid-campaign or delete anything without warning.

6. Plans and billing

  • Free — unlimited funnels and responses, subject to fair use. Free funnels display a small “Made with Cinch” badge. We may apply reasonable technical limits to protect the service from abuse.
  • Pro — billed monthly or annually in advance through our payment provider. Prices are shown on the pricing section and exclude VAT where it applies.
  • Cancelling — cancel any time and you keep Pro until the end of the period you have paid for. We do not pro-rate part-months.
  • Refunds — if something is genuinely broken, email us and we will sort it out fairly.
  • Price changes — at least 30 days' notice by email, and they take effect at your next renewal.
  • Failed payment — we will retry and email you. Pro features pause if payment stays outstanding; your funnels and data are not deleted for non-payment without warning.

7. Payments you take through Stripe

If you add a checkout card to a funnel, you connect your own Stripe account. Money flows directly to you and Avalore Ltd never holds it. Your relationship with Stripe is governed by their terms, and you are responsible for what you sell, for fulfilling it, and for your own refunds, tax and consumer-law obligations.

8. Our intellectual property

The Cinch software, brand and templates remain ours. Templates are provided for you to copy, edit and publish as your own funnels; you may not repackage them as a competing template library.

9. Availability

We work to keep Cinch available but we do not promise uninterrupted service during beta, and no formal uptime commitment applies. Planned maintenance is announced on the status page where practical.

10. Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for lost profits, lost revenue, lost leads, lost data or indirect losses, and our total liability in any 12-month period is limited to the greater of the fees you paid us in that period or £100. The service is otherwise provided “as is”.

11. Ending the agreement

You can close your account whenever you like. We may suspend or close an account that breaches these terms, or where required by law. On closure you can export your data, and we delete it as described in the privacy policy.

12. Changes

We may update these terms. For material changes we will email account holders and update the date at the top of this page. Continuing to use Cinch after that means you accept the new version.

13. Law

These terms are governed by the laws of England and Wales, and its courts have exclusive jurisdiction. Consumers keep the benefit of any mandatory protections in their home country.
